What if I was not wearing a helmet?

It does not end the claim. Texas assigns responsibility by percentage, and a claimant can recover so long as the claimant is not more than 50 percent responsible. Helmet use is also not relevant to how the collision happened, only potentially to certain injuries, and it is frequently argued far beyond what the evidence supports.

Preserve the bicycle

Do not repair or discard the bicycle, the helmet or the clothing. Damage patterns establish impact direction and speed. Photograph the scene, the sight lines and any obstruction, and look for camera coverage the same week.
