A Deliberately Small Caseload

Most law firm websites are vague about this, so here it is plainly.

Why does this firm keep a small caseload, and what happens when a case needs more?

The caseload is small on purpose

This office keeps a deliberately limited number of cases open at one time.

The reason is not modesty. It is that the alternative, in a practice this size, is a client who signs with a lawyer and then deals with a case manager for two years. Keeping the number down is what makes it possible for the lawyer you speak with on the phone to be the lawyer who actually works your file, knows the records, and takes the call when something changes.

That is a trade. It means this firm cannot take every case that calls. It also means the cases it does take get an attorney’s attention rather than a queue position.

When a case needs more than this firm

Some cases require resources beyond what a small firm carries alone. A case against a national trucking company with a rapid response team and a tower of excess insurance. A case that will need six figures of expert work before it is tried. A case where the right result depends on a trial team rather than a lawyer.

When that is true, we say so, and we bring in co-counsel.

Three things about how that works, because they are the things clients care about and rarely get told:

The client’s total attorney’s fee does not increase. Associating another firm divides the fee that already exists between the lawyers. It does not create a second fee. A client does not pay more because a second firm is on the case.

It happens only with the client’s written consent. The client is told which lawyers and which firms would be involved, and how the fee would be divided, before anything is signed. It is the client’s decision, not ours.

Jacob Schiffer remains the client’s lawyer. He does not hand the file over and step away. He remains counsel, remains responsible for the case, and remains the person the client calls.

Why we tell you this before you hire us

Because the alternative is worse for everybody.

The version of this that clients resent is the one where they hire a lawyer, and months later the case quietly turns out to be somewhere else with someone they never chose. Saying it up front means a client can decide with the information in front of them.

And because the math favors it. A share of a case that was handled the way it needed to be handled is worth more, to the client and to this firm, than a larger share of a case that was not.
