The First Call After a Sexual Assault

The first call is a private conversation with a lawyer, not an interview.

What is the first call to a lawyer like after a sexual assault?

The first call is a private conversation with a lawyer, not an interview. You decide how much to say, and you do not have to decide anything on the call. There is no charge to talk, and no attorney’s fee unless there is a recovery.

If this happened in the last few days, the exam and the video are the two things that cannot wait. Start with our page on what to do now after a sexual assault in Houston, then call 713-521-0059 or send a message.

Who answers when you call?

At Schiffer Law Firm you talk to a lawyer, not to a third-party legal intake service or a call center. Mr. Schiffer’s team reaches out as soon as possible with a short written questionnaire to clarify the key facts, and once your answers are received a call with Jacob Schiffer is scheduled promptly. You can call, or you can write first through the contact page.

We are a small firm and there is no guaranteed response time, but we typically respond within 12 to 24 hours of a call or message.

What do we need to know at the outset?

To determine whether a potential civil claim may exist after a sexual assault, we usually need only a few basic facts at the outset: who was involved, where and when the assault occurred, the status of any criminal investigation, and the type of commercial or institutional setting involved. That may include a hotel, apartment complex, bar, rideshare service, workplace, clinic or similar establishment. In most cases, that information is enough for us to begin evaluating the potential legal issues and have a meaningful first conversation.

You do not need a police report, an exam or any paperwork to call. See do I have to report to the police.

What stays private?

What you tell a lawyer about your own case is protected by the attorney-client privilege. We do not contact the police, the business or anyone else about you without your consent.

Texas makes one exception, and we tell you about it up front. Under Section 261.101 of the Texas Family Code, any person, including a lawyer, who has reasonable cause to believe a child has been abused must report it. If the survivor is an adult, that rule does not apply.

If a case is filed, a court can allow it to be filed under a pseudonym so that your name does not appear in the public record. For a child, Section 30.013 of the Civil Practice and Remedies Code requires the court to protect the child’s identity. See suing without your name in Texas.

What happens at the end of the call?

One of three things. We tell you a civil claim may exist and what the next step is. We tell you we need to look at something first, or ask you for additional information we need for our review. Or we tell you plainly that this is not a case we are best suited for, and we try to guide you on where else to turn.

What should you have ready, if you can?

Nothing is required, but the more evidence you have organized, the better. If you have them, the name of the commercial establishment or business, the date, any receipt, booking, ride record or screenshot, and the names of anyone you told. Do not delete anything from your phone, and do not sign anything a business gives you before you call.

How Schiffer Law Firm Can Help You

When you call, we listen first. Then we do what your case needs. That usually begins with a written preservation of evidence notice to the hotel, apartment complex, bar, rideshare company or anyone else holding critical evidence.

Where the case calls for it, we bring in the right experts and, where it serves you, specific co-counsel with the unique resources a case like this demands. That decision is made in writing, with your consent, and it does not increase your total attorney’s fee.

Schiffer Law Firm is a Houston firm and has handled injury cases in Harris County for 50 plus years. There is no charge to talk, and no attorney’s fee unless there is a recovery.

Frequently Asked Questions

Do I have to tell the lawyer everything that happened on the first call?

Technically, no. But the more information you can provide, the better we can evaluate whether a civil claim is viable. You decide how much to say, and you can stop at any point.

Will the lawyer report it to the police?

Not without your consent, if you are an adult. Texas requires any person, including a lawyer, to report suspected abuse of a child under Section 261.101 of the Family Code.

Does calling a lawyer start a lawsuit?

No. Calling starts a conversation and, if you choose, the written notices that keep the evidence. Whether to bring a claim is your decision, made later.

Can I message instead of calling?

Yes. The contact page reaches the same lawyer. There is no guaranteed response time, but we typically respond within 12 to 24 hours.

What if I do not know who did it?

You can still call. A civil claim is usually against the business whose failure let it happen, and it does not depend on identifying or convicting the person.
